Terms and Conditions – New Empowered You

1. Introduction
These Terms and Conditions outline the agreement between you (the client) and me, Olga Willemsen, trading as New Empowered You (Chamber of Commerce: 74866788). By participating in my services, programs, or purchasing Digital Products, you acknowledge and accept these terms. 2. Definitions

  • I / Me / My: Olga Willemsen, offering services under the company New Empowered You.
  • You / Client: The individual engaging in services, programs, or purchasing products.
  • Program / Session Services: Any form of therapeutic or coaching service offered by me, including online or in-person sessions, one-on-one or in groups, educational materials, and other information transfers.
  • Digital Products: Standalone audio recordings (such as hypnotherapy, relaxation, or coaching recordings) and bundled audio programs sold separately from sessions, delivered digitally via an email download link.

3. Offer and Agreement
Offers are made via my website, webinars, or other channels and are valid for the period stated. An agreement is established once you confirm your participation or purchase, and payment is received. I commit to a best-efforts service; however, results cannot be guaranteed. In exceptional cases, part of the service may be provided by a third party. If any changes are necessary, you will be informed beforehand.

4. Payment 
All sessions, programs, and Digital Products must be paid in full before they begin or are delivered. You will receive an invoice or payment confirmation via email. Payment plans for program services may be discussed individually in cases of genuine need.

5. Cancellation and Refund Policy

5a. Session Services and Programs
You have the right to cancel your participation within 14 days of registration, provided no sessions have taken place. In this case, you will receive a full refund. After this period, or once a session has occurred, cancellation is no longer possible. If you discontinue a multi-session program, a partial refund may be granted at my discretion, based on the individual session rates listed on my website.

5b. Digital Products – 14-Day Satisfaction Guarantee
All Digital Products are covered by a 14-day satisfaction guarantee from the date of purchase. If you are not satisfied for any reason, simply contact me at info@new-empowered-you.com within 14 days, and I will issue a full refund. No lengthy explanation is required.

Refunds are processed to the original payment method within 5–10 business days. This guarantee is a voluntary commitment and meets or exceeds your statutory rights as a consumer under applicable EU law.

6. Rescheduling and Missed Appointments
Appointments can be rescheduled free of charge up to 48 hours in advance. Cancellations or changes made within 48 hours of the appointment are charged in full.

7. Services and Digital Product Access

Session Services
You may receive digital materials or recordings during your program. These are for your personal use only and may not be shared, copied, or distributed. It is your responsibility to ensure a stable internet connection and working equipment for online sessions. I am not liable for missed content due to technical issues on your end.

Digital Products
Upon purchase, you will receive a download link via email. It is your responsibility to download and save the file promptly. If you experience a technical issue with the download link (for example, an expired link), contact me, and I will resend it. Digital Products are for your personal use only and may not be shared, copied, resold, or distributed in any form.

Please do not listen to audio recordings while driving, operating machinery, or in any situation that requires your full conscious attention.

8. Scope of Practice
I am not a licensed physician, psychologist, or medical professional. Hypnotherapy is not a substitute for medical or psychological care. Clients are advised to continue any prescribed treatment and consult their healthcare provider when necessary.

9. Results Disclaimer
While hypnotherapy has helped many people, results vary. Your commitment, willingness, and personal circumstances all influence the outcome. I cannot guarantee specific results.

10. Intellectual Property
I retain full copyright over all materials I create, including audio recordings, written materials, and program content. Nothing in these terms grants you any intellectual property rights beyond the personal license to use materials as described herein.

Session recordings: I may create personalized audio recordings during or after sessions with your verbal or written consent. These are provided for your exclusive personal use only.

Digital Products: Standalone and bundled audio recordings sold as Digital Products are licensed to you for personal use only. You may not reproduce, share, resell, or distribute them in any form.

11. Confidentiality and Data Protection
Your personal data is handled with care. Information shared during sessions is confidential. Exceptions include situations where there is a risk of harm to yourself or others, abuse of children or vulnerable adults, or a legal obligation to share information.

I may consult with professional colleagues to enhance your care, always keeping your identity anonymous unless you have given permission otherwise. For full details on how your personal data is processed, please see my Privacy Policy.

12. Liability
I am not liable for any direct or indirect damages related to the use of my services or Digital Products. Participation in sessions is voluntary, and use of Digital Products is at your own discretion. You are responsible for how you use any knowledge, tools, or guidance provided. My liability is limited to cases of proven legal or contractual fault, and does not exceed the amount paid by you for the relevant service or product.

13. Legal Jurisdiction
These terms are governed by Dutch law. Any disputes that arise will be subject to the jurisdiction of the courts in the Netherlands. Nothing in these terms affects your rights as a consumer under applicable EU law.
